That's the story most conversations about AI risk start with. It's a good story. But it misses the more common version of what's actually happening in businesses right now. The policy most businesses have (and what it doesn't cover)
Ask most business leaders whether they have an AI policy and you'll get one of two answers. Either they don't have one yet (and they know it) or they do have one, and it covers the basics: use approved tools, don't share sensitive data, review AI output before it goes out. That second answer is where the real problem lives.
A policy written to address the idea of AI use and a policy written to address how AI is actually being used in your specific operation are two very different documents. Most businesses have the first kind.

What Shadow AI actually looks like — and why it's hard to see
Shadow AI doesn't arrive as a security incident. It arrives as a time-saving habit.
An employee pastes a client contract into a free AI summarizer to get through a long document faster. Someone uses an AI chatbot to draft an HR communication, including employee names and performance details in the prompt. A manager shares a financial summary with a public model to get a quick analysis before a meeting. No one is being reckless. Everyone is trying to move faster.
The problem is that many consumer-grade AI tools use the inputs they receive to improve their models. That means your business data (client names, contract terms, financial figures, internal communications) may be processed and retained outside your environment, under terms most people never read.

Why Florida and California businesses face this differently
The legal and regulatory context around data exposure varies significantly depending on where your business operates and who your clients are.
In California, the CCPA and CPRA give individuals significant rights over their personal data, including data processed by third-party tools. If your team is feeding customer information into an AI platform that falls outside your vendor agreements, you may be creating compliance exposure without any awareness that it's happening. California's enforcement posture around data privacy has been aggressive, and regulators don't distinguish between intentional misuse and accidental exposure.
In Florida, the Digital Bill of Rights introduced consumer data protections that place new obligations on businesses handling personal information. For companies in professional services, healthcare, legal, finance, or real estate, the combination of sensitive client data and informal AI use is a specific, documented compliance risk.
For businesses operating across both states, or serving clients in either, the exposure isn't hypothetical. It's a question of when it surfaces, not whether it exists. A generic AI policy written without reference to these regulatory environments isn't a policy. It's a placeholder.
What AI governance that fits your operation actually requires
The answer isn't to prohibit AI. That creates a different problem: your competitors use it, your team finds workarounds, and you lose the productivity gains while keeping the exposure.
The answer is governance that was built from your operation outward, rather than from a template inward.
That starts with understanding what AI is already in use; not just what you've approved, but what's actually running. Built-in integrations, browser extensions, tools embedded in software your team uses daily. That inventory doesn't exist in most businesses because no one has looked for it.
From there, it means mapping which data flows are actually at risk. Not all AI use carries the same exposure. An employee using AI to draft an internal meeting summary carries different risk than one using it to summarize a client contract or process patient records. Governance that treats all AI use identically will be ignored because it creates friction where none is warranted and provides no guidance where it matters most.
None of this is about restricting your team. It's about designing a system where AI works within your business instead of around it.
